Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Zmanim, a Delaware corporation ("etmol", "we", "us"), governing your access to and use of the etmol website at etmol.ai and the related service that turns photos you provide into a generated video (the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

etmol lets you upload photos, optionally add music, and have the Service automatically produce a montage video, including AI-generated transitions. Output is produced by automated models and is provided on an "as is" basis; results vary and are not guaranteed to meet a particular expectation.

2. Eligibility & accounts

You must be at least 16 years old (or the age of digital consent in your country) and able to form a binding contract. You are responsible for activity under your account and for keeping your login secure. Authentication is handled through our identity provider; you must provide accurate information.

3. Your content & the rights you grant

You retain ownership of the photos, audio and other materials you upload ("Your Content") and of the videos the Service generates for you ("Output").
You represent and warrant that you own or have all necessary rights to Your Content, including the rights to any people depicted, music, trademarks and copyrighted works, and that processing it through the Service does not infringe any third party's rights or any law.
You grant us a limited, worldwide, royalty-free license to host, process, transmit and transform Your Content solely to operate and provide the Service to you (including sending it to the third-party processors listed in our Privacy Policy).

4. Acceptable use

You agree not to use the Service to create, upload or distribute content that is unlawful, infringing, defamatory, sexually exploitative, depicts or targets minors, promotes violence or hatred, impersonates others, uses a person's likeness without authorization, or otherwise violates these Terms or applicable law. You may not attempt to disrupt, reverse engineer, scrape, overload or circumvent the Service or its usage limits.

5. Pricing, packages & payments

Paid features are sold as one-time purchases (for example, a video package sized by photo count, or removal of the watermark from a generated video). Included retries and transitions are described at the point of purchase. Current prices, what each package includes, and any free tier are shown at checkout and on the Service; that information is incorporated into these Terms by reference.

Payments. When you buy, you are purchasing directly from Zmanim. Card payments are processed on our behalf by Stripe (Stripe, Inc. and its affiliates); we do not receive or store your full card number. Charges appear on your statement with an "etmol" or "Zmanim" descriptor, and Stripe's own terms apply to its processing of the payment. Prices are in USD and are exclusive of any taxes; you are responsible for any sales tax, VAT or similar that may apply, except where we are required to collect it, in which case it is shown at checkout.

6. Refunds

Purchases are digital and the applicable refund and cancellation rules are set out in our Refund Policy, which forms part of these Terms.

7. Intellectual property

The Service, its software, design, branding and the "etmol" name are owned by us or our licensors and are protected by law. Nothing in these Terms transfers those rights to you. We may use anonymized, aggregated data about usage to operate and improve the Service; we do not claim ownership of Your Content or Output.

8. AI output disclaimer

Output is generated algorithmically and may contain artefacts, inaccuracies or unexpected results. You are responsible for reviewing Output before you publish or rely on it. The Service is not intended for uses where an error could cause harm.

9. Disclaimers & limitation of liability

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free or secure. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service will not exceed the greater of the amount you paid us in the three (3) months before the event giving rise to the claim, or USD 50. Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory consumer rights.

10. Indemnity

You will indemnify and hold us harmless from claims, damages and reasonable costs arising from Your Content or your breach of these Terms or of applicable law.

11. Suspension & termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or to protect the Service or other users. Sections that by their nature should survive termination (ownership, disclaimers, liability, indemnity, governing law) survive.

12. Changes

We may update these Terms; material changes will be reflected by the "Last updated" date and, where appropriate, additional notice. Continued use after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules, and the state and federal courts located in Delaware will have exclusive jurisdiction, subject to any mandatory consumer-protection rights in your country of residence.
